1The agreement
These Terms of Service ("Terms") are a contract between TintBoss LLC ("TintBoss", "we", "us") and the business that creates a TintBoss account ("you", "your shop"). By creating an account, or by using TintBoss, you accept these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
Our Privacy Policy is part of this agreement.
2Who can use TintBoss
You must be at least 18 and able to form a binding contract. TintBoss is business software sold to businesses; it is not a consumer product.
Access is currently invite-only. Creating a shop requires a valid invite code issued by us. Codes are issued to a specific business, may expire, and may be revoked before use. Sharing, reselling or publishing an invite code is a breach of these Terms.
3Accounts, roles and staff
- You are responsible for everything that happens under your account, including what your staff do.
- Keep credentials secure. Tell us promptly at support@tintboss.io if you suspect unauthorised access.
- You assign each person a role — owner, manager or installer — and those roles control what they can see. Installers cannot see pricing or your customer list. Assigning roles correctly is your job, and it is the main thing standing between a departing employee and your customer list.
- Remove staff accounts when people leave. We cannot know that someone no longer works for you.
4Trial period
New shops receive a free trial of 30 days from signup unless we state otherwise in writing. No card is required to start. At the end of the trial you must choose a paid plan to keep writing to your account. Nothing is deleted when a trial ends — see section 6.
5Subscriptions and billing
- Subscriptions are billed in advance through Stripe, our payment processor. By subscribing you also accept Stripe's terms for the payment itself.
- Subscriptions renew automatically at the end of each billing period at the then-current rate, until you cancel.
- You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for — you keep full access until then.
- We do not automatically refund partial periods. If something has genuinely gone wrong on our end, email us; we would rather sort it out than keep money we didn't earn.
- Prices may change. We will give at least 30 days' notice by email before a price change affects you, and you may cancel before it takes effect. Where we have committed to a founding-member rate for a specific shop, we will honour that commitment on the terms it was given.
- Fees exclude taxes. Where we are required to collect sales tax or similar, it will be added.
- If a payment fails, we will retry and notify you. Continued failure moves your account to read-only.
6If you stop paying
We do not hold your data hostage
When a subscription lapses, your account becomes read-only. You can still sign in, look up any customer, open any job, and export your records. You cannot create or edit new records until you resubscribe. Your data is not deleted, not locked away, and not held for ransom. Resubscribe and everything is exactly where you left it.
We may eventually delete data from accounts that have been inactive and unpaid for an extended period, but not without emailing the account owner first and giving a reasonable window to export or resume.
7Your data belongs to you
Everything you put into TintBoss — customers, vehicles, jobs, inspections, photos, documents, pricing — remains your property. We claim no ownership.
You grant us only the narrow licence we need to actually run the service: to host, store, back up, transmit and display your data so the software works for you, and so we can support you when you ask. That licence exists for your benefit and ends when your data is deleted.
You can export your data at any time, including while read-only. If you need a full export and can't get what you need from the app, ask us and we will produce it.
You are responsible for having the right to enter the data you enter, and for its accuracy.
8Texting and emailing customers
This is the clause most likely to cost you money — please read it
TintBoss helps you compose review requests and customer messages. TintBoss does not send them. The app hands the drafted message to your own phone's messaging app or email client, and it goes out from your number and your address, sent by you.
That means you are the sender in the eyes of the law, and you are solely responsible for complying with it — including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and do-not-call rules, and carrier requirements.
In practical terms: get consent before you text people, honour opt-outs immediately and permanently, and don't message customers who told you to stop. TCPA damages start at $500 per message and can treble. We provide the tool; the consent and the compliance are yours.
You must not use TintBoss to send unsolicited bulk messages, or to incentivise, filter, gate or otherwise manipulate public reviews in a way that violates Google's policies or consumer-protection law. Asking every customer for an honest review is fine. Asking only the happy ones, or paying for reviews, is not — and it can get your Google listing removed.
9Connecting Google
Connecting a Google Business Profile is optional. When you connect it you authorise TintBoss to read your business information and reviews, and to post replies you write. You must own or be authorised to manage the profile you connect.
Google controls its own APIs. Access may be restricted, rate-limited, or withdrawn by Google at any time for reasons outside our control, and some features depend on Google approving our access. We will tell you plainly when a limitation is Google's rather than ours, but we cannot guarantee availability of features that depend on Google.
You can disconnect at any time in Settings, or revoke access from your Google account directly.
10Acceptable use
Don't use TintBoss to:
- break the law, or help anyone else break it;
- store data you have no right to hold, or upload someone else's customer list;
- attempt to access another shop's data, probe our security, or circumvent access controls;
- resell, sublicense or white-label TintBoss without our written agreement;
- scrape, copy or reverse-engineer the service to build a competing product;
- upload malware, or deliberately overload or disrupt the service.
Finding a security flaw and telling us about it in good faith is not a violation of this section — it's a favour, and we will treat it as one. Email support@tintboss.io.
11Availability and support
We work to keep TintBoss available and fast, but we do not currently offer a contractual uptime guarantee or service-level agreement. There will be maintenance, and occasionally there will be outages. We will give notice of planned downtime where we reasonably can.
Support is provided by email at support@tintboss.io during ordinary business hours.
We may add, change or remove features. If we remove something you depend on, we will give reasonable notice and, where practical, a way to get your data out of it.
12About inspection records
TintBoss inspections are designed to document a vehicle's condition before and after work, and shops commonly use them to defend against chargebacks and damage claims.
We built them to be strong evidence. We cannot promise they will be accepted as evidence. Whether a bank, a card network, a court or an insurer credits a given record depends on the completeness of what you captured, the facts of the dispute, and rules we have no control over. TintBoss makes no representation that using inspections will win any dispute, and provides no legal advice.
13Disclaimer of warranties
TintBoss is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or that it will meet your requirements, or that data will never be lost. Keep your own backups of anything you cannot afford to lose.
14Limitation of liability
To the fullest extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, or lost or corrupted data, even if advised such damages were possible.
- Our total aggregate liability arising out of or relating to these Terms is capped at the greater of (a) the amounts you paid us in the 12 months immediately before the event giving rise to the claim, or (b) one hundred US dollars ($100).
Nothing in these Terms limits liability that cannot lawfully be limited — including liability for fraud, fraudulent misrepresentation, or willful misconduct. Some jurisdictions do not allow certain exclusions, in which case the exclusions apply only to the extent permitted.
15Indemnity
You agree to indemnify and hold harmless TintBoss LLC and its officers and employees from third-party claims, damages and reasonable legal costs arising from: your use of the service; data you entered; messages you sent to your customers; your violation of these Terms; or your violation of any law or third-party right.
This does not apply to claims arising from our own breach of these Terms or our own unlawful conduct.
16Termination
You may stop using TintBoss and close your account at any time.
We may suspend or terminate your account if you materially breach these Terms, if your use creates legal risk or threatens the security of the service, or if required by law. Except where the breach is serious or urgent, we will give you notice and a reasonable chance to fix the problem before terminating.
On termination for any reason, you have 30 days to export your data before we begin deletion, unless the law requires otherwise. Sections that by their nature should survive — data ownership, disclaimers, liability limits, indemnity, and governing law — survive termination.
17Changes to these terms
We may update these Terms. For minor changes we will update the date at the top. For changes that materially affect your rights or obligations, we will email account owners at least 30 days before they take effect. If you don't agree, cancel before the change takes effect; continuing to use TintBoss after that means you accept the new Terms.
18Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
Talk to us first
Before filing anything, email support@tintboss.io describing the problem and what you want. We commit to responding within 30 days and trying in good faith to resolve it. Most disagreements are a misunderstanding and a phone call.
If that fails, both parties consent to the exclusive jurisdiction of the state and federal courts located in Florida, and waive any objection to venue there. Each party may still seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or data.
Claims must be brought in an individual capacity, not as part of a class or representative action.
19Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between us regarding TintBoss, and supersede earlier discussions.
- Severability. If a provision is held unenforceable, the rest stays in force and the unenforceable part is narrowed to the minimum extent necessary.
- No waiver. Not enforcing something once doesn't waive the right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
- Force majeure. Neither party is liable for delays caused by events outside its reasonable control.
- No partnership. Nothing here creates a partnership, joint venture, employment or agency relationship.
